In Zadig , published in 1748, Voltaire wrote of “the great principle that it is better to run the risk of sparing the guilty than to condemn the innocent.” At about the same time, Blackstone noted approvingly that “the law holds that it is better that ten guilty persons escape, than that one innocent suffer.” In 1824, Thomas Fielding cited the principle as an Italian proverb and a maxim of English law. John Stuart Mill endorsed it in an address to (...) Parliament in 1868. General acceptance of this maxim continues into our own period, yet it is difficult to find systematic attempts to defend the maxim. It is treated as a truism in no need of defense. But the principle within it is not at all obvious; and since it undergirds many of our criminal justice policies, we should be sure that it is justifiable. Was heisst es, dass sich unsere geistigen Zustande auf eine Welt beziehen, deren Teil wir sind? Eine Analyse dieser Intentionalitat unserer geistigen Zustande muss sowohl die Rolle ihrer begrifflich-abstrakten als auch ihrer qualitativ-sinnlichen Aspekte genau bestimmen. In dieser Abhandlung wird der Versuch unternommen, eine Analyse des Verhaltnisses begrifflicher und nicht-begrifflicher Elemente im intentionalen Gegenstandsbezug durchzufuhren, und zwar auf der Basis einer systematischen Untersuchung von Kants Unterscheidung zwischen Sinnlichkeit und Verstand. Als Leitfaden dient die Auseinandersetzung, die Wilfrid Sellars uber einen langen (...) Zeitraum mit der theoretischen Philosophie Kants gefuhrt hat. Das hat zwei Grunde: Zum einen hat Sellars sich im Rahmen dieser Auseinandersetzung intensiv mit der kantischen Konzeption des Verhaltnisses von nicht-begrifflichen und begrifflichen Elementen in unserem intentionalen Weltbezug beschaftigt. Zum anderen war Kants Theorie fur Sellars keineswegs bloss von historischem Interesse, sondern hatte fur ihn bleibende systematische Bedeutung, da sein eigenes philosophisches System im Kern durch und durch kantisch ist. Sellars' Interpretation ist deshalb dazu geeignet, zwischen der exegetischen und der systematischen Perspektive zu vermitteln, deren Verbindung fur die Methodologie der vorliegenden Untersuchung charakteristisch ist.Die Auseinandersetzung mit diesen beiden Autoren soll dazu beitragen, die Frage nach der Beziehung von begrifflichen und sinnlichen Aspekten unserer Erfahrung zu klaren. Fur beide betrifft diese Frage den Kern der Problematik unseres Verhaltnisses zu einer unabhangig von uns existierenden Wirklichkeit. Ihre Beantwortung ist ein wesentlicher Bestandteil fur das Verstandnis unseres intentionalen Bezugs auf eine Welt, deren Teil wir sind. Die Auseinandersetzung mit teleologischen Vorstellungen ist in Kants Kritik der Urteilskraft an die Diskussion des Begriffs der Zweckmäßigkeit geknüpft. Einerseits wird dort eine subjektiv zweckmäßige Spezifikation der Natur einem transzendentalen Prinzip der Urteilskraft zu Grunde gelegt. Diese Möglichkeit wird durch die Darstellbarkeit dieses Begriffes eröffnet, den die Kritik der ästhetischen Urteilskraft thematisiert: Der Begriff einer subjektiven Zweckmäßigkeit wird durch das Wirken der Einbildungskraft in der Synthesis derjenigen Naturprodukte dargestellt, die wir als schön beurteilen.

Obwohl jüngere Interpretationen Descartes meist vor dem Vorwurf eines doxastischen Voluntarismus in Schutz nehmen, gibt es im Kontext der cartesischen Urteilstheorie erhebliche Schwierigkeiten mit seinem Begriff der Willensfreiheit. Vor allem zwei Aspekte von Descartes’ Theorie lassen sich auf den ersten Blick nur schwer miteinander vereinbaren: die unbegrenzte Freiheit des Willens auf der einen und die unweigerliche Zustimmung des Willens zu klaren und deutlichen Ideen auf der anderen Seite.Ich schlage zunächst vor, zur Lösung dieser Schwierigkeiten zwei verschiedene Begriffe der Willensfreiheit bei (...) Descartes zu unterscheiden, von denen jeder seinen spezifischen Anwendungsbereich hat: Freiheit als Wahlfreiheit und Freiheit als Spontaneität. In einem zweiten Schritt argumentiere ich, dass sich unter Voraussetzung von Descartes’ Urteilstheorie seine These der unbegrenzten Freiheit des Willens für beide Begriffe von Willensfreiheit verteidigen lässt, ohne dass Descartes deshalb zum doxastischen Voluntaristen würde. Mit der Renaissance der Metaphysik in den letzten Jahren hat sich auch die Reflexion auf ihre Grundlagen intensiviert. Die auf Kant zurückgehende Frage nach der Möglichkeit der Metaphysik jedoch, so scheint es, bleibt in diesen Auseinandersetzungen dennoch weitgehend außen vor. Zwar steht diese Frage im Hintergrund, wenn zum Beispiel darüber diskutiert wird, ob wir das Unternehmen der Metaphysik realistisch oder nicht-realistisch auffassen sollten. Nach einer unmittelbaren Auseinandersetzung mit der Frage jedoch, unter welchen Bedingungen realistisch verstandene Metaphysik möglich ist, suchen wir (...) meist vergebens. -/- Realistisch verstandene Metaphysik untersucht die allgemeinste Form der Welt (oder Realität, Wirklichkeit usw.). Wie ist eine solche Untersuchung möglich? Metaphysik, die auch ihre eigene Möglichkeit zum Thema macht, ist eine dem Anspruch nach kritische Metaphysik. Wir glauben, dass Metaphysik nur dann ihre eigene Möglichkeit thematisiert, und also den Anspruch erhebt, kritisch zu sein, wenn sie in ihrer Untersuchung der Form der Welt auch eine Untersuchung der allgemeinsten Form des Denkens ist. Ohne eine Untersuchung der Form, die Denken als Denken der Welt aufweist, kommt die Frage nach der Möglichkeit der Metaphysik, nach der Möglichkeit des Denkens der Form der Welt also, gar nicht erst in den Blick. Nur, wenn das Verhältnis der Form des Denkens und der Form der Welt Gegenstand der Überlegung ist, kann Metaphysik den Anspruch erheben, kritisch zu sein. Wie wir dieses Verhältnis genauer zu beschreiben und verstehen haben, muss Gegenstand der Auseinandersetzung über ein angemessenes Verständnis kritischer Metaphysik sein. Einer solchen Auseinandersetzung soll hier Raum gegeben werden. Der vorliegende Schwerpunkt ist der Versuch einer Bestandsaufnahme kritischer Metaphysik in der deutschsprachigen Gegenwartsphilosophie. Wir verstehen ihn als eine Plattform der Auseinandersetzung darüber, wie der Anspruch, kritische Metaphysik zu betreiben, überzeugend erfüllt werden kann – als eine Plattform der Auseinandersetzung über ein angemessenes Verständnis kritischer Metaphysik also. Background Implementing person-centred care (PCC) in nursing homes is challenging due to a gap between theory and practice. Bridging this gap requires suitable education, which focuses on learning how to attune care to the values and preferences of residents and take moral, relational, and situational aspects into account. Staff’s stories about the care they provide (i.e. caring stories) may deliver valuable insights for learning about these aspects. However, there is limited research on using staff's narratives for moral learning. Objective This (...) study aims to provide insight into the perspectives of nursing staff on using their caring stories to learn about PCC. Research design In this qualitative research, we conducted two rounds of interviews with 17 participants working in nursing homes. We wanted to obtain nursing staff’s perceptions of working with their caring stories and the impact on PCC. Ethical considerations Participation was voluntary, and participants provided written consent. The study protocol is approved by The Institutional Review Board of the Medical Ethical Committee Leiden-Den Haag-Delft. Findings Working with caring stories enables nursing staff to provide PCC and improves job satisfaction. It increases awareness of what matters to residents, fosters information rich in context and meaning, and enhances voice and vocabulary. Through in-depth team reflections, nursing staff discussed the significant moments for residents, which centralizes the discussions on the moral quality of care. Discussion Working with caring stories fosters dialogue on PCC and enhances reflection on ethical situations in daily encounters, contributing to the moral development of nursing staff. Putting nursing staff’s narratives at the centre of learning suits their daily practice and intrinsic motivation. Therefore, the outcomes of this study are an addition to the existing literature about using narratives in long-term care. Conclusion Using nursing staff's narratives contributes to PCC and positively impacts nursing staff. We recommend using staff's caring stories as a vehicle for moral learning in the transition to PCC. (shrink)

The vast majority of philosophers and legal theorists who have thought about the issue agree that there is such a thing as a moral right to privacy. However, there is little or no theoretical consensus about the nature of this right. According to reductionists, the right to privacy amounts to nothing more than a cluster of property rights and rights over the person, and therefore plays no autonomous explanatory role in moral theory (Thomson 1975, Davis 1959). Among non-reductionists, there are (...) almost as many accounts of the right to privacy as there are synagogues in the old town of Jerusalem. For one group of non-reductionists (perhaps the majority), the right to privacy is properly understood as a right of control, a form of autonomy. Within this group, some think that the right to privacy is the right to control information about oneself (Westin 1967, Beardsley 1971, Gerstein 1978, Fried 1970, Moore 2003), while others insist that it is the right to control access to oneself (Parker 1974, Scanlon 1975, Rachels 1975, Reiman 1976, Van den Haag 1971). For another group of non-reductionists, the right to privacy is the right to cognitive and/or physical inaccessibility (Gavison 1980, Garrett 1974, Allen 1988). Though these are by far the most widely adopted non-reductionist accounts of the relevant right, they are by no means the only ones currently on offer. There are hybrid accounts according to which the right to privacy is a cluster of various rights of control (Inness 1992) or a cluster of various rights of control and restricted access (DeCew 1997). And according to an influential “information-based” account, the right to privacy 1 is defined as the right that others not possess undocumented personal information about the right-holder (Parent 1983a; 1983b). The purpose of this paper is to bring some order to this theoretical chaos. On my view, none of these accounts of the right to privacy is accurate.. (shrink)

The problem of justifying legal punishment has been at the heart of legal and social philosophy from the very earliest recorded philosophical texts. However, despite several hundred years of debate, philosophers have not reached agreement about how legal punishment can be morally justified. That is the central issue addressed by the contributors to this volume. All of the essays collected here have been published in the highly respected journal Philosophy & Public Affairs. Eine französische Ausgabe, in der Übersetzung von Emmanuel Levinas und Gabrielle Pfeiffer, erschien 1931 bei A. Colin in Paris. Husserls Arbeiten an dem Manuskript für die deutsche Ausgabe, die gegenüber (...) der französischen erheblich erweitert werden sollte, blieben, nicht zuletzt wegen der 1933 veränderten politischen Situation, unvollendet. Husserl on the Ego and its Eidos (Cartesian Meditations, IV) ALFREDO FERRARIN THE THEORY OF the intentionality of consciousness is essential for Husserl's philosophy, and in particular for his mature theory of the ego. But it runs into serious difficulties when it has to account for consciousness's transcendental constitution of its own reflective experience and its relation to immanent time. This intricate knot, the inseparability of time and constitution, is most visibly displayed in Husserl's writings from the 192os up to (...) the notion of the eidos ego in the fourth Cartesian Meditation. In this paper I want to dwell on the most problematic aspects of this theory. After a few preliminary remarks about the intentionality of consciousness (sec- tion 1), I try to place the theory of the substrate of habitualities in the context of Husserl's evolution on the issue of the reflection of the ego on itself (section ~). Husserl's Entwicklungsgeschichte on the topic of the pure ego has already been the object of important scholarly works, of which Kern's 1964 Husserl und Kant seems to me the best example. But what the secondary literature does not do is develop thematically the ambiguities of Husserl's definitions of consciousness and temporality in a unitary and comprehensive way. While I follow the lead of Berger, Broekman, Kern, Marbach,' and others, I find that their work does not sufficiently stress the difficulties at the core ofintentionality and reflective time- consciousness. Therefore, although section 2 is a necessary presupposition for drawing some critical conclusions in the final two sections, it does not exhaust my theme. After clarifying the peculiarity of the notions of essence, intuition, tran- scendental and apriori, as well as their irl:educibility to a Kantian meaning, I turn to the "de facto transcendental ego" resulting from eidetic variation (section 3) in order to introduce an examination of temporality. The difficul- ties in the twofold requirement, namely, that consciousness be the identical subject of its Erlebnisse and be synthetically unified in time, concern the unity, primacy, and mutual relation of time and consciousness in the constitution of our experience. They have been heady pointed out by Ricoeur in his commen- tary on the Cartesian Meditations. But what I want to argue in section 4, going beyond Ricoeur's text, is that the tension between temporally constituted and constitutive consciousness in the ego's reflection on its own retentions and protensions does not simply make the question of time ambiguous, but has crucial and problematic bearings on the very definition of consciousness as intentionality.
